An Open letter to Blue Oregon readers

Editor's note: What follows is a comment written by Jake Weigler, Steve Novick's campaign manager, in response to a series of smears against Steve Novick on the Democratic blog, Blue Oregon, which is run by Merkley for Senate's online media advisor, Kari Chisolm.

We have encouraged partisans on both sides of the Democrats primary divide to end the pillow fight without much success. I am reposting Jake's comment here in it's entirety because it is a measured and reasonable response in a primary that has gotten out of hand with its negativity, particularly among online supporters of both candidates.

This is a difficult post to write … actually it’s not, but as it will be the last time the Novick campaign writes on this blog until the end of the primary, I decided to make it a good one.

The choice to give Mr. Kamberg, the latest online Merkley hatchet man, the keys to Blue Oregon should come as a surprise to no one who has been closely following this primary and its treatment on this site. Not content to let Kevin’s relentless stream of attacks and smears sit on his own site, Kari Chisholm, the Merkley campaign’s online consultant, has chosen to given Kamberg a bigger soapbox from which to launch a string of false attacks on Steve Novick. I will get to the “substance” of his charges below, but first this needs to be called out for what it is.

It is page one of the political establishment’s playbook to first ignore an outsider challenger and then, when he can’t be ignored, tear him or her down with a series of lies, fabrications, smears and innuendos. The Merkley campaign has clearly adopted that strategy in the last week. After dredging up a 1998 letter to the editor to mislead voters about Steve’s 1996 vote for Ralph Nader – a letter that appeared on Mr. Kamberg’s blog hours before the media reported the Merkley campaign was pushing it around. And then Merkley himself claimed on the radio that Steve had "recently" praised Nader.

When Speaker Merkley was called out on that lie in Friday’s debate, he chose to compound that falsehood by again lying about Steve’s record, claiming:

“When Nader said Democrats and Republicans are the same, you agreed and I disagreed. I disagree with your statements about being profoundly disappointed about the candidates in the democratic primary.”

Steve, of course, never said that he agreed there was no difference between the Republicans and Democrats or that he was “profoundly disappointed” by Senators Obama or Clinton. To claim his vote for Nader in 1996 suggests that he agrees with everything Nader has ever said is analogous to saying that because Jeff Merkley voted for Clinton in 1996, he must support NAFTA and the Defense of Marriage Act.

This is only a new chapter part of a repeated pattern on this site and elsewhere by Merkley’s surrogates to misrepresent Steve’s record and statements and attack his integrity. In the last few weeks, we’ve been falsely accused by the Merkley campaign of selling beer. Meanwhile, Merkley’s spokesperson even went so far as to question “whether Steve Novick cares if Gordon Smith is reelected.”

Kari, of course, is a paid media consultant of the Merkley campaign – actively coordinating with message rollout as he has acknowledged on multiple occasions. Chisholm’s claim that he only speaks for himself, while he is receiving remuneration from the campaign is untenable. A conflict of interest is a conflict of interest, regardless of whether you pledge that your integrity means you can rise above it. And the idea that you can suddenly take off your Merkley campaign cap to offer independent analysis on the race is ridiculous. I have noted previously how that relationship seems to have affected balance in coverage of the race, but today I am specifically talking about the repeated pattern of using this ostensibly neutral community as a vehicle to extend and amplify the attacks by the Merkley campaign on Steve Novick (of which Mr. Kamburg is the latest example).

Kari started off this primary with a bang, calling Steve’s disagreement with Merkley’s vote on HR 2 - “swiftboating,” – a label that earned him Rogue of the Week in the WWeek.

Kari was also, of course, the source of the extended PDA smear that ran in January. I’ve avoided revisiting that subject out of interest of helping the PDA-Oregon chapter get off the ground. After being called on the carpet for “misrepresenting” his conversation with National PDA director Tim Carpenter, I though Kari would learn to be more careful in how he handled this race. As Liz has said, she should have handled this process more carefully. But as the kitchen sink strategy moves into full gear, I feel compelled to give a more complete picture.

First, Kari omitted from his extended hit job that the fact that the Merkley campaign had subsequent conversations with PDA-National where they indicated they were fine with the revised process moving forward – before he posted his breathless account.

Second, Kari wrote “The last time I called to confirm a source on something Steve had said, Jake Weigler said (and I'm paraphrasing here), ‘I'm not going to comment about this to a Merkley campaign consultant. If a real reporter calls me, I'll talk to them.’” That is a blatant misrepresentation of that conversation. I was asked the levels of proof we had whether Steve had opposed the Iraq war before it started. As I knew that the Merkley campaign was already engaged in a false whisper campaign that Jeff was the only one to publicly oppose the war before it began (a line they decided to make quite public at Friday’s debate), I was not enthused about helping a Merkley media consultant fine tune that attack.

Of course, this pattern is nothing new to the readers of Blue Oregon. In August, a then-anonymous blog published by a Mitch Greenlick staffer was immediately noted by Blue Oregon and then later used to promote an attack on Steve’s record on taxes. Greenlick himself, along with Rep. Nolan, also used the site in October to smear Steve by accusing him of being an “opportunist” running for a “selfish personal agenda.” The Merkley campaign later confirmed to the Oregonian that they had reviewed the statement before it ran.

Now Mr. Kamberg, who by my count has posted no less than 15 attacks on Steve Novick since January has been given posting privileges. It is hard not to see this as using this progressive community as window dressing to smear Steve Novick. I am sorry to have to say this, particularly to Jeff Alworth, Charlie Burr and the other contributors that have made this the centerpiece of Oregon’s progressive blogosphere, but I cannot allow this behavior to go unaddressed.

Now to Mr. Kamberg’s post.

  • LIE - Henry in no way “doctored” Wikipedia. As the history of the edits clearly shows, he changed the text surrounding the discussion of Merkley’s vote of 2003’s HR 2 to include the full resolution text – rather than simply the lines stating support for the troops. As it read at the time, you would think that Jeff Merkley voted to support the troops and Steve Novick was criticizing that decision. But, it was not appropriate for Henry – as someone receiving payment from the campaign – to go into a user-based forum and make changes. Which is why Kari’s dodge about “I only speak for myself” inappropriate, just as it was inappropriate for Henry, while he was receiving money from the campaign, to make those changes.
  • LIE - SB 124 did not “allow proposed charter schools” to “bypass[] “the district's rejection” “and appeal directly to the State Board of Education.” As Steve and his ODE associate’s testimony on that bill makes clear, that bypass option was already in the statute. This bill was a housekeeping measure to clarify that process. (Listen for yourself if you think that’s an unfair characterization).
  • And as for this whole “speak truth to power” dichotomy Kevin wants to create, it seems pretty silly. It is pretty common knowledge in Oregon political circles that Steve turned down a job in the Governor’s office after the 2002 campaign over political differences with the Governor. Part of the reason he went to work at ODE was that he would have the freedom there to continue his push against the dramatic overpayments to video lottery retailers. Now to criticize him for refusing to cut off his nose in spite of his face seems pretty disingenuous – particularly for someone trumpeting the importance of “prudence.” What was he supposed to do, fly off the handle against his boss at a committee meeting and announce his resignation? That would be a sign of authentic leadership in your mind?

More generally, sometimes the only way to win a rigged game is to refuse to play. I hope this post makes that clear and others will see the treatment of this race on Blue Oregon for what it is – an extension of the Merkley campaign’s attacks on Steve Novick’s integrity.

Jake is running a fantastic campaign for Steve. This response is typical of what I've come to expect from him, watching this campaign as I have, from the cheap seats.

BO and Merkley conflict of interest

I have left comments at BO, using several different email addresses. As soon as Merkley announced for the Senate seat, I was automatically subscribed to several copies of his announcements, newsletters, etc., even though I never signed up for them. I noticed that these unsolicited emails were addressed to the exact email addresses I had used to leave comments on BO.

Truthy post

There's not much Kari can do at this point to salvage Blue0. By my rough count, there have been about 120 posts on the senate race since Merkley was recruited. They run about a 3 to 1 pro-Merkley slant.

Macpherson, Brown and Adams are getting their money's worth to a lesser extent.

Attack on Kari

This attack on Blue Oregon and Kari makes absolutely no sense and is taking mudslinging to a new level by the Novick campaign. Kari has disclosed his ties to Merkely, but he has contributors who represent both sides Merkely and Novick, just as he has contibutors who support both Hillary and Obama, and I can vouch for that, because I am a Hillary supporter and I have seen a fair play given to both at BO. So this claim that BO and Kari are biased is hogwash. Maybe 3 out of 4 comment posters on BO like Merkley better (like myself). That doesnt mean BO is biased to Merkely.

Lets face it, Jeff is a stronger candidate, likeable, with a good track record in the legislature to get things done by bringing both sides together. He has been a good speaker. He is getting strong endorsements and has a better chance of beating Gordon Smith.

I have a strong opinion about this!

Even playing fields . . .

There are very few of them in politics. Election campaigns are, after all, adversarial processes by their very nature. Each side naturally seeks to grasp every possible advantage.

It is ironic that the Novick campaign would boycott Blue Oregon, the only major political blog in the state which has both Novick and Merkley supporters among its "front pagers." Requiring neutrality on an activist blog is a ludicrous notion on its face, made even more so by the campaign's obvious embrace of blogs which place the shoe so clearly on the other foot. How many Merkley supporters can be counted among the Loaded Orygun front pagers, for example?

Frankly, it is more of an insult to the readers of Blue Oregon than its editors and contributors that the Novick campaign would choose to "take its ball and go home" rather than provide us with reasoned rebuttals to issues which have been raised in its articles.

Nor does the comparison to the sorry Wikipedia and PDA episodes ring true. Both of those organizations have very clear guidelines which were ignored by Novick campaign staffers. In the PDA case, the candidate himself showed up at an endorsement meeting which had been called without the required notice to the membership, or position questionnaires having been given to the candidates, let alone completed and published as required by the organization's policies and procedures.

The Novick campaign waited several weeks to address this issue, and lacking any comparable behavior by Merkley staff members, now grasps at the straw of branding any vocal Merkley supporter a "surrogate."

As a member of the team of Oregon State Coordinators for PDA, I would have preferred that the Novick campaign had stuck to its resolve to move on, rather than drag our organization into the "spin room" yet again. PDA responded swiftly to restore integrity to its endorsement process, and has gotten back to the important work of organizing its over 2,500 Oregon members into local chapters and mobilize them to effect progressive change. It serves neither candidate in the current senatorial race well to undermine those efforts, and could have lasting implications long after this campaign is but a memory.

So, despite the protestations of the Novick campaign, I will continue to be an occasional reader and even more occasional contributor on several Oregon political blogs. I'm not so naive as to expect them to be neutral on issues or candidates. And, for the record, I find Blue Oregon to be more objective than most... including this one.

Some inconvenient facts

1. Novick's HR 2 attack on Jeff Merkley was swiftboating exactly as Kari said. Rather than hide from it he should embrace it.

2. Jake Weilger's characterization of PDA director Tim Carpenter's chat with Kari Chisolm semi-skillfully skirts the much more important issue which was his own campaign's attempt to game an endorsement.

3. Where is the evidence that Steve Novick opposed the Iraq War from the beginning as he claims? Alleging a "whisper campaign" by the Merkley campaign doesn't answer that central question.

4. "Doctored" is in fact a textbook correct description of what paid Novick staffer HenryK did to Merkley's Wikipedia page, as Merriam-Webster plainly explains.

5. Kevin Kamberg appears to have incorrectly characterized what SB124 did. Point to Jake Weigler.

6. Crunch the numbers on the net financial benefit to Oregon Public Schools of Novick's choice to go after lottery commissions versus not fighting NCLB as the OEA plaintively called for back then. It's not even close!

"Oregon Progressive" has got it largely wrong.

1. "Swiftboating" requires a lie.
It is a FACT that Jeff Merkley voted for HR2, and the content of HR2 is a fact and a matter of public record. Many of us share the concern that this vote shows that Merkley is susceptible to getting rolled by Republican resolutions that wrap the flag around toxic poison pills of substance. Would Merkley have voted for the USA PATRIOT Act if it said a few kind words about the troops?

2. The PDA owns its endorsement process.
If the PDA is content that no improprieties were committed, and as Jake pointed out, even the Merkley campaign was on board with the process, then Kari's three separate smears on Liz Kimmerly were pure spin.

3. Steve Novick opposed the Iraq war from the beginning.
Are you disputing Steve's truthfulness in characterizing his views?! Not sure what you are looking for here by way of an alibi. He wasn't an elected official (as Jeff's partisans tirelessly point out) so it's not as if he had a voting record or the kind of access to the media Jeff had during that period.

4. Wikipedia is designed to be edited by its readers.
Please see this explanation from a member of the Oregon Wiki Project (who is not a partisan of either candidate) about the utter lack of remarkableness of what Henry Kraemer did.

5. Kevin Kamberg gets a few things wrong.

6. The Lottery lawsuit and NCLB are not either-or propositions.
Your juxtaposition of the two is logically fallacious. Neither excludes the other. However, everyone involved acknowledges that Steve Novick was the mastermind of the Lottery lawsuit, and I think most people who are paying attention would admit that George W. Bush was the mastermind of NCLB.

I wish Merkley's supporters would focus on the actual issues where he and Steve disagree, and let the voters choose based on that, instead of flinging all this mud.

Novick bloggers have never said anything negative about Merkley

Right. I have been focusing on the issues when it comes to Merkley, I try and stay out of the mud. So, there is a pro-Merkley blogger who has posted negative pieces on Merkley, what about you? Have you not posted some negative stuff about Merkley as well? It seems quite hypocritical for the Novick Campaign and their supporters to be whining about a blogger's negative attacks, when they have been doing the same thing for months. It's a primary...it's bound to happen!

Please feel free to back up the assertion that Steve Novick opposed the Iraq War from the very beginning. I for one would love to see the evidence because all I've seen is assertions.

...When his errors are exposed, Kari likes to say something to the effect of "Don't assume malice when incompetence can explain..."
It could be that he has banned so many people from Blue0 that he really didn't know what you were talking about. The first time I found my commenting "privileges" suspended, he told me he had no idea and that it must have been a mistake. (He also couldn't remember my email inquiry into my mistaken bannination when I addressed the matter with him face to face as well.)

The casual reader may conclude that your comment is nothing but troll fodder. (Personally, I think you made your point in the first paragraph (if not the subject line itself). But I see the trouble you went to, not only with formatting and alliteration, but with the word plays as well. That appeals to me as a linguist.

That said, I wish you hadn't gone there in that way. Your comment is hard to read on many levels. Let me give you one example. By equating Pimentel with Chisholm, you lose your argument in the second paragraph. If they're all liars, then your beef with BO comes off overdone, like a Sunday joint left cooking all night. It's evil. And people don't want to touch it.

Pat,

In the last few weeks, you have threatened me with "payback" for having the audacity not to support your candidate of choice. Now, apparently, I'm a Naderite -- though I've never voted for the man, and oppose him being on the ballot in Oregon. Whatever.

The Independent Party provides ballot access for candidates who would not otherwise have an opportunity to run for public office. Some of them are progressives, like Frohnmayer. Some are moderate Republicans or Democrats who don't believe that they can win in eastern Oregon.

Some of them are conservatives with whom I have nothing in common other than a belief that our current system is broken, and that we need to try and set up competitive two-way races in one of the literally dozens of districts that would not otherwise be contested in 2008.

You may not agree with what we are doing, but I'd appreciate it if you would at least have the courtesy to try and understand what we are doing before you attack it.

Did you forget that Blue Oregon is a blog? Every blog on the web is filled with partisans. Heck, I'm a partisan, and I'm not ashamed to admit it. I got FP'd over at Blue Oregon once, you could try it too. They front page columns submitted by bloggers. Will the Novick Campaign distance themselves from Loaded O too? It's a partisan blog. Merkley has had his fair share of negative attacks made by pro-Novick bloggers as well. It's a primary for christ sakes, this is going to happen.

The problem with ethics isn't Kari its the Novick Campaign

Kari owns a blog and he lets people write on it. Call the press!

Kari discloses his financial stake in the campaign and lets readers make an educated decision whether to believe the for themselves. Steve Novick likes to go around saying that voters are smart enough to make informed decisions. Does Novick not believe that bloggers (who are also voters) shouldn't be trusted to make informed decisions about whether to believe Kari or not? Does he think we are all sheep?

Secondly, Kari, unlike Novick staffers, discloses his conflict of interest. Henry Kraemer violated wikipedia's conflict of interest policy. Lizy Kimmerly failed to disclose her conflict of interest. This seems to be a systematic problem with the Novick campaign.

Thirdly, Jake, are you saying that Loaded Orygun should be forced to cover the race in a way that is more pro-Merkley because you don't seem to be complaining about bias when it works in your favor.

Finally if you cant handle Blue Oregon you cant handle the crap Gordon Smtih is going to throw at you. Buck up and stop crying.
